Malco Products, Inc., and its Affiliates (collectively, “Malco”) recognize that you care about how your information is collected, used, processed, stored and shared by Malco. This Privacy Policy describes how Malco deals with your personal and other information that may be obtained by Malco, including through its websites (including https://www.malcoautomotive.com), any mobile version of its websites, any devices, its online stores, and its products and services (collectively, “Malco’s Sites”). By accessing any of Malco’s Sites, you are consenting to the practices and authorizations described in this Privacy Policy, and you agree to be bound by its terms. If you do not agree to be bound by the terms of this Privacy Policy, you may not access or use Malco’s Sites.


PERSONAL INFORMATION WE COLLECT

Malco may collect personal information about you from numerous sources, including directly from you, from your friends or contacts, from cookies and tracking technologies used by Malco, from service providers who may assist Malco, from other third parties that provide information to Malco, and from sources providing publicly available sources. Malco may also combine information that it obtains from various sources.

Personal Information that Malco may collect include:

  1. Contact information such as your name, address, phone number, e-mail address, and IP address,

  2. Audio recordings of conversations or transcripts of online chats gathered through contact with Malco’s customer service team,

  3. Product information such as the item/model and number of products that you have purchased, where/when the products were purchased, and communications about a product,

  4. Information about your shopping preferences and purchases,

  5. Survey and demographic information, such as age, household information, product purchase history, and employment information, such as job title and location,

  6. Financial/economic information such credit card or debit card information and other information provided at the time of purchase,

  7. Internet and other electronic activity that is gathered automatically when you visit Malco’s Sites or interact with our advertisements, such as browsing and search history, browser information and device type, and

  8. Inferences that may be drawn from any of the information that we collect to create a profile about you which reflects your preferences and characteristics.

 

WHY WE COLLECT PERSONAL INFORMATION

 

Malco collects and uses your personal information for various purposes. We may collect and use information for internal and business operational and commercial purposes, so that we may fulfill requests for products, administer product programs and warranties, respond to customer service inquiries, answer questions about our products, and communicate with our customers. We may maintain records of your contacts with our customer service team for internal research and for training and quality control purposes. We may collect and use contact information and product information to enable us to provide customers with notice of any product recalls, advisories or safety notices, and as necessary to respond to legal/regulatory inquiries and demands, and in order to comply with our legal and contractual obligations. We may collect and use your information to determine shopping preferences, for survey purposes, and for development of demographic information for marketing, advertising and product development purposes; we may also collect and use your information for marketing purposes in order to market goods and services or those goods and services of our Affiliates, business partners and other third parties. This information enables Malco to learn about our customers and develop products that meet their needs and preferences.

 

For those who provide personal information in the context of their employment with Malco or as part of an application for employment, personal information will be used for employment purposes, such as keeping updated organizational information, making hiring and employment related decisions, employee training, and employment investigations.

 

Malco will use reasonable efforts to limit the collection and use of personal information to what is reasonably necessary to fulfill the purpose for which the personal information is collected. Malco may use de-identified, anonymized, or aggregated versions of your personal information for any purpose.

 

HOW WE COLLECT YOUR PERSONAL INFORMATION

 

Malco will obtain personal information from numerous sources, including:

 

  1. Through Malco’s Sites when you purchase or return a product,

  2. When you create a customer account,

  3. When you contact our customer service team, whether it is by phone, email, chat or regular mail,

  4. When you post information through our social media sites, and

  5. When you sign up to receive emails and newsletters.

 

We also collect your personal information when you:

 

  1. Purchase, register or return a product through Malco’s Sites,

  2. Register products by mail,

  3. Contact our customer service team by phone, mail, or email, and

  4. Submit a warranty claim.

 

When you visit Malco’s Sites, we may collect information that does not personally identify you, but is helpful for administering Malco’s Sites, analyzing trends, tracking user movements, and gathering broad demographic information for aggregate use. This information includes (a) IP address; (b) domain name; (c) type of computer; and (d) type of web browser. Malco’s Sites also utilize cookies to store information required to determine how to properly deliver content to your device.

 

We also collect information from other sources. We may receive your personal information from Affiliates, authorized distributors, and other business partners who assist us in marketing and advertising efforts, customer service support, or product services. We may also get information about you from friends who purchase products for you as a gift or who provide us with your information in response to a marketing campaign.

 

INFORMATION SHARED WITH THIRD PARTIES

 

Malco may share your information with its Affiliates, such as any parent entity, subsidiary entity, or any affiliated entity.

 

Consistent with this Privacy Policy, Malco may share your personal information with third party service providers. These third parties include vendors, subcontractors, distributors, sales representatives, service providers, or other businesses with whom we have partnered to provide a product or service to you. For example, these third parties may need access to information about you or the products that you have purchased in order to process your transactions, such as your order, your credit card or debit card issuer, a third-party credit verification company, the product handler, the delivery service, and any vendors that may ship products to you directly from their warehouse. We may also share your information with other service providers such as Information Technology providers, internet service providers, and data analytic providers. In addition, we may share information with banking and financing partners who provide financing for the purchase of our products.

 

Malco may share your personal information with third parties that provide support services to us such as marketing consultants, printers, web hosting providers, call center/chat providers, or other third parties that help us market our products and services. These third parties may need access to information about you to perform these services. We do not authorize these third parties to use the information that we disclose to them for any other unrelated purpose.

 

Malco also provides access to third parties to enable consumers to share their reviews about Malco’s products. Should you choose to share a customer review, these third parties may place cookies on your browser or use web beacons or similar technologies to collect information. (For more information regarding the use of cookies, see section titled “Cookies and Other Tracking Technologies.”) In addition, these third parties may receive information about the Malco products that you have purchased.

 

Malco may also share your personal information as required by law, in order to investigate suspected fraud, harassment, or other violations of law or regulations, and to investigate suspected violations of any terms or policies applicable to Malco’s Sites or the services or products provided by us or our third party providers or Affiliates. Malco may also transfer your personal information in connection with a sale of assets, merger, change of control, bankruptcy, or other similar transaction. You will be notified by email (sent to the email address specified in your account) or notified by the posting of an updated Privacy Policy on Malco’s Sites if such a transaction results in the transfer of control of your personal information to a non-affiliate.

 

You may contact us to opt out of such sharing in some cases. (For more information regarding your options, see the section below titled “Requests to Opt-Out or Delete Your Personal Information.”) However, Malco does not control how its service providers and business partners use and share your information once they receive it. You will need to contact such business partners directly for information about their privacy practices or to exercise rights that you may have, including whether you would like to opt-out of receiving future emails from a business partner.

 

OUR COMMITMENT TO CHILDREN'S PRIVACY

 

Malco is committed to the preservation of online privacy for all visitors to Malco’s Sites, including children. We sell products intended for purchase by adults (those age 18 or older). If you make a purchase using Malco’s Sites, you are representing that you are an adult. We will not knowingly collect any personal information from children under the age of 18 without the consent of that child’s parent or guardian. If you are a child under the age of 18, you are not authorized to use Malco’s Sites without consent from your parent or legal guardian. If Malco becomes aware that personal information from a child under age 18 has been collected without such child’s parent or legal guardian’s consent, Malco will use all reasonable efforts to delete such information from our database.

In all cases, to protect your privacy and integrity of your personal information, Malco will ask that you verify your identity and/or verify that you are authorized to make a request under this section. You may be asked to provide your website account information (if you have one), provide information regarding a product that you have purchased or registered, and/or verify certain personal information previously provided to Malco before Malco undertakes any actions to delete your information.

 

Please understand that Malco may not delete personal information that is necessary for meeting applicable legal requirements, such as carrying out warranty obligations, providing safety advisories, recalls, and notices, responding to legal or regulatory inquiries, preserving information relevant to a legal claim or lawsuit; and in the case of information provided by employees, information that is necessary for making promotions, appointments, or other employment decisions. For certain more sensitive personal information (which may include credit card or debit card information, race, gender, religion, medical information), Malco will provide an affirmative or explicit (opt in) choice if the personal information is to be disclosed to a third party for use in a manner incompatible with the purpose for which it was collected. Malco will not discriminate against you for exercising your rights under this section.

 

ACCESS, RECTIFICATION, SUPPRESSION AND REJECTION

 

You are entitled to access your personal information that we possess and the details of the processing of such information in order to rectify the information whenever it is incomplete or imprecise, to suppress the information if you determine that the personal information is not required for the purposes set forth herein, or if it is being used for purposes for which you have not consented, or to otherwise object to the processing of your personal information.

 

You may update, remove, or correct your personal information on record with Malco by logging into your account (if applicable), or by contacting us through the methods listed in the sections titled “Request to Know” or “Request to Opt-Out or Delete Your Personal Information.” To protect your privacy and security, we also take reasonable steps to verify your identity before granting access or making corrections. We will respond to all inquiries with respect to updating, removing, or correcting your personal information within a reasonable time and in compliance with applicable laws.

 

Any application for the exercise of the aforementioned rights must necessarily indicate and include: (i) your name and home address, (ii) copy of your official ID (passport, voter’s ID, driver’s license), (iii) a clear and precise description of the personal information that you wish to access, rectify, suppress or object to, and any other component which facilitates the obtainment of your data, and (iv) any other requirement that may be set forth under applicable law.

 

Malco will respond to any complete application within 20 calendar days or the maximum term permitted under applicable law. Malco’s reply will indicate whether the application for access, rectification, cancellation or objection is appropriate, and in such case, Malco will make its decision within the following 15 calendar days or the maximum term permitted by the applicable law to the date in which the answer was delivered to the owner of the Personal Information or his/her representative. The terms may be extended pursuant to the applicable provisions. If you are exercising your right of access, Malco may provide you with electronic copies of your personal information.

 

LIMIT USE OR DISCLOSURE

 

You are entitled to limit Malco’s use or disclosure of your personal information to those purposes described under this Privacy Policy. If you wish to limit use of your personal information, please contact our Information Privacy Department by mail or email, stating the purposes for which you wish to limit the use or disclosure of your personal information.

Additionally, you may register with public registries of consumers to avoid having unwanted information sent to you. For additional information please consult your national or local authority for consumer protection.

 

ONWARD TRANSFER

 

Malco will keep your personal information private and confidential, unless you have authorized Malco to transfer your personal information under the terms of this Privacy Policy or such disclosure is necessary in order to:

  1. Comply with federal or state law, a court order or other legal process,

  2. Protect Malco’s rights or property, or

  3. Enforce Malco’s Terms of Use.

If you have not otherwise authorized the transfer of your personal information under this Privacy Policy, then prior to transferring personal information to a third party, Malco will apply the aforementioned Notice and Choice principles. Malco will confirm with such third party that it subscribes to the principles described within this Privacy Policy and that the third party provides at least the same level of privacy protection provided by Malco.

 

SECURITY

 

No data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, despite our efforts to protect your personal information, Malco cannot ensure or warrant the security of any information you transmit to us online. You transmit all such information at your own risk.

 

Once Malco receives the transmission of your personal information, Malco will take reasonable measures to ensure that the personal information is safeguarded. Malco has put in place reasonably appropriate physical, electronic, and managerial procedures to protect such personal information under its control against the loss, misuse or alteration. Malco’s data networks are secured and protected by firewalls and other safeguards. In addition to technological measures, Malco has also safeguarded the personal information stored on our premises, including restricting access and using locked and secured storage units.

 

In the event of a breach of our systems and unless a law enforcement agency informs us that notification would impede a criminal investigation, Malco will notify you, as soon as reasonably possible, of any unencrypted personal information that we have reason to believe has been obtained by an unauthorized person.

 

DATA INTEGRITY

 

Malco will use the personal information only for the purposes for which it was collected or for such purposes as subsequently authorized. To the extent necessary for those purposes, Malco will take reasonable steps to confirm that personal information is accurate, current, complete, and reliable for its intended use.

 

ENFORCEMENT

 

Malco uses a self-assessment approach to ensure compliance with this Privacy Policy. This includes a periodic assessment to verify that the Privacy Policy is sufficiently comprehensive and being adhered to by Malco. Malcoautomotive.com does not impose a registration requirement. You have the choice to create an account. However, an account will enable you to register your recently purchased product, if appropriate, place additional purchase orders, and rate and review our products, among other benefits. If you choose not to register, you will be able to access all areas of Malcoautomotive.com website that do not require registration.

 

Whether you choose to register when you visit Malcoautomotive.com or not, Malco automatically tracks and collects the following anonymous information that does not personally identify you, but is helpful for administering the site, analyzing trends, tracking user movements, and gathering broad demographic information for aggregate use: (a) IP address; (b) domain name; (c) type of computer; and (d) type of Web browser.

The collection, processing, and the use of data collected during the registration process requires your consent. This consent may be declared electronically and as noted above you may withdraw your consent at any time as set out in the Opt-Out and Access Rectification, Suppression and Rejection sections of this Privacy Policy.

 

COOKIES AND OTHER TRACKING TECHNOLOGIES

 

Similar to other websites and applications, Malcoautomotive.com may automatically collect certain information regarding the users of Malco’s Sites. Such information may include the Internet Protocol (“IP”) address (which may be used to determine your geographic location) of your computer/internet service provider, your device ID, your zip code, the date and time that you accessed Malco’s Sites, the Internet address of a referring website, the operating system that you are using, the sections or pages of Malco’s Sites that you have visited, and the images and content that you have viewed.

 

Malco’s Sites utilize cookies for several purposes, including the storage of information required to determine how to properly deliver content to your device. A cookie is provided to all visitors to Malcoautomotive.com, regardless of whether you create an account. ONLINE BEHAVIORAL ADVERTISING

 

Malcoautomotive.com engages in Online Behavioral Advertising (“OBA”) in accordance with the Guidelines set forth by the Digital Advertising Alliance. Malco uses anonymous cookies to track information on your browsing history on malcoproducts.com, and third-party advertising networks use the information in order to deliver targeted advertising to you on Malco's behalf on other websites throughout the Internet. These cookies do not contain personally identifiable information, nor are they linked to any personal information collected by Malco.

You may opt-out of third-party advertising networks by using the multi-cookie opt-out mechanism of Network Advertising Initiative (“NAI”) at:  http://www.networkadvertising.org/managing/opt_out.asp  These opt-outs are valid only for the computer and browser combination used to opt-out. Clearing cookies will remove these opt-outs because they stored in cookies.

 

Additionally, Malco may employ, either directly or through third parties, tracking pixels. DATA RETENTION

 

Malco will retain your personal information for as long as your registration is active, as reasonably determined by Malco, and for a reasonable time thereafter, or such other period of time as prescribed by law. Malco may also retain your information for a longer period of time as needed to provide you with products or services, or as necessary, to comply with its legal obligations, to resolve disputes, or to enforce its agreements. Notwithstanding the fact that Malco may have deleted some or all of your information, Malco may continue to retain and use anonymous data previously collected and/or anonymize and aggregate your personal information.

 

CHANGES TO THIS PRIVACY POLICY

 

From time to time, Malco may desire to collect additional categories of personal information or use personal information collected for additional purposes. If Malco’s information practices change at some time in the future, or if Malco, in its sole discretion, decides to change, modify, add or remove portions of this Privacy Policy, Malco will provide you with notice by posting the revised Privacy Policy on its websites. If you are concerned about how your information is being used, Malco suggests that you periodically review Malco’s Sites and contact its Information Privacy Department with any concerns.

 

CALIFORNIA PRIVACY RIGHTS

In accordance with the requirements of the California Consumer Privacy Act of 2018 (the “California Privacy Act”), the following is a summary of the personal information that Malco collects, the sources for the personal information, the purposes for which Malco uses such personal information for a business or a commercial purpose, and the situations where and with whom Malco has shared or shares such personal information.

 

The categories of personal information that Malco collects are described in the section of this Privacy Policy titled, “Personal Information We Collect.” The categories of sources of personal information from which Malco collects personal information are described in the sections of this Privacy Policy titled, “How We Collect Your Personal Information,” “Cookies and Other Tracking Technologies,” and “Online Behavioral Advertising.” The business and/or commercial purposes for which Malco collects personal information are described in the sections of this Privacy Policy titled, “Why We Collect Personal Information,” “Information Shared with Third Parties,” and “Registration.” The situations where and with whom Malco shares such personal information are described in the sections of this Privacy Policy titled, “Information Shared with Third Parties” and “Onward Transfer.”

 

Malco does not “sell”, as defined under the California Privacy Act, a consumer’s personal information for cash consideration. However, the California Privacy Act defines the term “sale” to include many of the common ways that websites share data. Therefore, it is possible that a sharing of data by Malco with one of its Affiliates or with third party service providers with whom Malco has partnered, could be considered a “sale” under the California Privacy Act.

    3. Characteristics of protected classifications under California law or federal law, such as age and gender;

    4. Commercial information such as products or services purchased and content streaming activity;

    5. Internet or other electronic network activity information, including content interaction information, browsing history, search history, and a consumer’s interaction with an Internet website, application or advertisement;

    6. Geolocation data, such as the location of the consumer’s device or computer;

    7. Audio or visual information, including audio recordings of calls with customer service or images and videos collected or stored in connection with interactions with Internet websites;

    8. Professional or employment related information; and

    9. Inference data such as information about consumer’s purchase preferences.
    •    Categories of Personal Information Disclosed for a Business Purpose.

     

    In the 12 month period prior to the effective date of this Privacy Policy, Malco has shared with third parties certain personal information for a business or commercial purpose that fall within the following categories established by the California Privacy Act:

     

    1. Identifiers such as name, address, phone numbers or IP address when Malco uses third party providers;

    2. Personal information such as credit card or debit card numbers when Malco uses a third party payment processor;

    3. A customer’s age, gender, or other protected classification when the consumer chooses to participate in a survey distributed by a survey provider;

    4. Commercial information including the details of a product or service that the consumer purchased if a third party service provider assists to provide the product or service to the consumer;

    5. Internet or other electronic network activity information when Malco uses a service provider;

    6. Geolocation data such as when a third party provider must deliver a package to the consumer;

    7. Audio or visual information when a service provider is used by Malco to review customer service phone calls for quality assurance purposes or when service providers fulfill a purchase order; and

    8. Professional information when Malco provides account details to a service provider for verification purposes.

     

    • Right to Request Access or Delete Personal Information.

     

    You may have the right under the California Privacy Act to request information about the collection of your personal information by Malco, or to access or delete your personal information, as more fully described under this Privacy Policy. If you desire to exercise your rights, please contact Malco’s customer service representatives as described in the Privacy Policy in the section titled, “Request to Opt-Out or Delete Your Personal Information.”

     

    1. No Discrimination.
